acknowledgement and waiver of liability.

This is a legally binding contract between you, the authorized signer as indicated below, hereinafter referred to as "Client" and Jesse R. Booker K-9, LLC, herein after referred to as "JRB K-9". Please read this agreement carefully, this is a release of liability and waiver of certain legal rights.

The undersigned agrees to the following terms and conditions: 

Client's participation in any service offered by JRB K-9, including but not limited to Behavioral Training, Boarding, Training Sessions, or Board-and-Train programs, herein after collectively referred to as "Training" may expose Client and Client's animal to unexpected risk. These risks include, but are not limited to: illness, falls, bites, injuries sustained through contact with other animals, people, or any interior/exterior surroundings of the facility/facilities where training takes place. As a condition of participation, Client understands and accepts these risks to themselves and to Client's animal.
Client understands that training does not end when the session does. Client's continued participation within the home is mandatory. Developing a relationship between Client and Client's animal while practicing the skills learned are the proverbial 'keys to success'. 

At JRB K-9’s discretion, Client may bring family members or guests as additional attendees to Training. Client agrees that Client and Client alone assumes full and complete liability for any and all risk of injury of any kind to family members or guests attending Training with Client. Minor children are prohibited from attending Training. 

Client hereby expressly agrees to hold JRB K-9 and its employees, owners, and agents harmless from any liability whatsoever resulting from any injuries or damages sustained as a result of participation in the Training, including incidents that may be attributed to Client's negligence or carelessness. 

Client, including any attending family members/guests, as an individual and on behalf of their respective heirs, successors and/or assigns, hereby expressly waive, release, and discharge JRB K-9 and its employees, owners, and agents, including owners of the property on which Training takes place, from any claims, demands, injuries, damages or causes of action that are in any way related to the participation in Training, up to and including including incidents that may be attributed to Client's negligence or carelessness.

JRB K-9 makes no representations, guarantees, or promises, implied or expressed, that any Training received from JRB K-9 will "cure" the animal of any dangerous propensities. It is fully understood that regardless of the behavioral training received by the Client's animal, animals always possesses the propensity to bite, jump, or kick resulting in injury and/or death. Client hereby agrees to indemnify and hold harmless JRB K-9, its employees, owners, and agents, up to and including owners of the property on which training takes place, and their employees and agents, harmless from any and all claims or claims by any members of Client's family, or any other person while on the grounds of any home or facility where training takes place, the surrounding area thereto, or on JRB K-9 property, or in a public area, from any and all liability as a result of any action by any animal, including Client's own. 

Client affirms and has proof, to be supplied upon request of JRB K-9, et al, that Client's animal is current on all vaccinations appropriate for Client's animal.
Client agrees to abide by all rules presented during Training. Client also understands that JRB K-9 may use publicity pictures of Client's animal or Client for promotional purposes without liability or obligation to Client.

Abandonment Clause: 


Client understands and agrees that JRB K-9 is a professional dog training service and does not operate as a boarding or kennel facility beyond the scope of contracted training services. If a dog is not retrieved within fourteen (14) business days of the scheduled pick-up date and no prior arrangements or reasonable communication have been made by the Client, the dog shall be considered abandoned pursuant to California Civil Code Section 1834.5. In such cases, JRB K-9 reserves the right to transfer the dog to a local animal shelter or rescue organization without further notice. The Client shall remain fully responsible for all outstanding balances, as well as any additional costs incurred as a result of abandonment, including but not limited to extended care, transportation, shelter fees, and any legal or collection costs. JRB K-9 reserves the right to pursue legal action to recover such amounts.
